Vaping Legal Consequences - Ottawa County

  • Anyone under the age of 18 is considered a minor within the law;
  • It is illegal for any minor to purchase/possess/use any type of vaping product;
  • An 18-year-old student in possession of a vape would be subject to only a school consequence.

If a minor violates any of these conditions they will be subject to:

1st Offense:
State civil infraction and shall not be fined more than $50.00. The court may order the individual to participate in health promotion and risk reduction assessment program, if available. In addition, the court may order the individual to perform no more than 16 hours of community service.

2nd Offense:
State civil infraction and shall be fined not more than $50.00. The court may order the individual to participate in health promotion and risk reduction assessment program, if available. In addition, the court may order the individual to perform no more than 32 hours of community service.

3rd Offense:
The individual is guilty of a misdemeanor punishable by a fine not more than $50.00 for each violation.

Pursuant to a probation order, the court may also require the individual to participate in health promotion and risk reduction assessment program, if available. The court may order the individual to perform not more than 48 hours of community service.
